Not illustrated. 1922 Excerpt: ...and a party defendant claimed that these lands were covered by the lien of a judgment obtained by him against the ancestor; this defence was overruled and the mortgage held to be the prior lien. Held, that the proceeds of sale of the property should be applied, after the payment of the ancestor's creditors (where so liable) to the mortgages of the heir, in the inverse order of their dates.--Warren v. Raymond, 17 S. C. 163. (D) RIGHTS AND REMEDIES OP CREDITORS OF HEIRS AND DISTRIBUTEES. (c)=153. Right to subject interests in estate in general. Creditor may follow the land of his debtor, in the hands of his heirs, after a great lapse of time, on the failure of personal assets; peculiar circumstances preventing the operation of the statute of limitations, or the usual effect as a bar, of a great lapse of time.--Higginson v. Air, 1 Desaus. 427. =3157. Actions and other proceedings by creditors. Creditor's bill, see Creditors' Suit, (c)=11. A distributive share of an intestate's personal estate, in the hands of an administrator, cannot be levied on by an attachment for the debt of one of the distributees. Vide Young v. Young, 2 Hill Rep. 425, and Murrell v. Johnson 3 Hill, 12. But a bill may be entertained in this court, to subject the funds of an absent debtor, not the subject of attachment at law. to the payment of his debts. Vide Rowden v. Schatzell, 1 Bail. Eq. Rep. 360, 23 Am. Dec. 170.--Kinloch v. Meyer, Speers, Eq. 427. Where an absent debtor is entitled as distributee to funds in the hands of an administrator or the commissioner in equity, as such funds cannot be reached by process at law, a bill in equity will lie to subject them to the claims of his creditors.--S.
